1. General

1.1 These Terms and Conditions govern your use of the Viranoma website (www.viranoma.com) and services provided by Viranoma LLC ("we," "us," "our"). By using our services, you agree to these Terms.

2. Scope of Our Services

2.1 Our Role: We provide an online platform connecting users with dental and healthcare providers ("Clinics") worldwide, primarily in Turkey. Through our platform, you can request information and receive quotes for medical treatments.

2.2 Intermediary Role: We do not provide medical services and are not responsible for the accuracy of information provided by you or the Clinics. We only facilitate the transfer of information between you and the Clinics.

2.3 Direct Contractual Relationship: When you select a Clinic, you enter a direct contractual relationship with the Clinic for medical services. We are not a party to this agreement and do not assume liability for medical services provided.

2.4 Third-Party Responsibility: We are not a healthcare facility ourselves, do not provide any services and limit ourselves to the role of an intermediary and technical service provider. All medical services are provided by third-party Clinics in Turkey, which are solely responsible for the quality and outcomes of your treatment. We are not liable for any acts, omissions, or services provided by the Clinics. All treatments are provided by independent Clinics, and we do not assume any responsibility for the quality or outcomes of such treatments.

2.5 Free of Charge to Users: Our services are free to you. We are compensated by the Clinics we cooperate with. We are not responsible for third-party websites linked through our platform.

2.6 Indemnification: The Clinics are contractually obligated to indemnify Us against any medical claims or legal actions arising from your treatment. By using our platform, you agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our services or any treatments received from the clinics.

3. Booking a Treatment and Payment Terms

3.1 Treatment Booking: You may book treatments with our partner Clinics through our platform. Receiving a quote does not obligate you to book a service.

3.2 Appointment Deposit: To secure a booking, a non-refundable deposit of £200 is required. This amount is deducted from the total and final treatment cost payable to the Clinic. Late cancellations may result in forfeiture of the deposit. Our fee is derived from the Clinics as a referral commission and does not affect the price you pay.

3.3 Payment Process: Payment for medical services is made directly to the Clinic. We collect and hold the Appointment Deposit on behalf of the Clinic.

3.4 We make every effort to ensure our treatment cost is accurate. If there is a pricing error, we will verify the correct amount before confirming your Booking. If the actual cost is lower, you will be charged the lower amount. If it is higher, we will inform you and seek your approval before proceeding with your booking.

3.5 Payment Terms: a) Payment is required to confirm a booking. b) Payments may be processed through third-party providers. We are not responsible for additional fees or issues arising from third-party payment services. c) Payment is accepted in Pounds (UK users), Euros (EU users), and USD (US and other users). d) The Appointment Deposit must be paid within 48 hours after receiving a quote. e) Refunds are only available if: You cannot travel or proceed with treatment due to medical reasons, provided you submit written proof from a doctor at least 7 days before your appointment. You exercise your Right of Withdrawal under Section 5.

f) The Appointment Deposit is valid for 12 months, allowing you to reschedule your treatment twice within this period.

4. Conditions of Use, User Obligations

4.1 You must be at least 18 years old and have full legal capacity to use our services.

4.2 You agree to provide accurate and complete information. Any changes to your information must be promptly communicated to us in writing.

4.3 By submitting materials protected by intellectual property rights (e.g., medical records), you grant us a non-exclusive license to use and share these materials with Clinics for the purpose of obtaining quotes and facilitating treatment.

5. Your Right of Cancellation

5.1 You have the right to cancel this agreement within 14 days without providing a reason.

5.2 To exercise your cancellation right, you must send a written notice to Viranoma LLC via email or mail within 14 days of booking.

5.3 If you cancel, we will refund all payments minus any non-refundable expenses we incurred such as payment fees we processing the deposit payment. Refunds will be issued using the original payment method.

6. Our Right of Cancellation

6.1 We may end the contract by notifying you in writing if: (1) you fail to make a payment when due and still do not pay within 5 days of our reminder; (2) you do not provide necessary and accurate information, such as medical details, within a reasonable time; or (3) you do not allow us to complete the dental procedure within a reasonable time.

6.2 We may also terminate the contract if you behave disrespectfully toward our staff or other clients. This includes, but is not limited to, sexual harassment, threats, excessive drinking, and drug use, which we will not tolerate.

6.3 If we end the contract for these reasons, we will refund any fees for unprovided procedures but may charge compensation for any costs caused by your breach.

6.4 We are not responsible for any additional costs related to travel, accommodation, or other losses due to changes or cancellations, especially if caused by circumstances beyond our control.

7. Travel Insurance

7.1 It is your responsibility to obtain adequate insurance to cover the dental procedure, including travel insurance and any other necessary coverage. We strongly recommend securing this insurance before your trip and ensuring it meets your needs.

7.2 We are not responsible for any additional costs or expenses during your trip, including those typically covered by insurance.

8. Travel Requirements

8.1 Before traveling to Turkey, ensure your passport is valid and obtain a visa if required (visit eVisa for more details).

8.2 If you cannot enter Turkey or are deported, the cancellation terms will apply. You are responsible for covering any additional costs, including medical assistance.

8.3 If you need emergency medical care during your trip, we will assist in arranging it and notify your travel insurer and next of kin as soon as possible.

8.4 You book all travel at your own risk. If your consultation reveals a health issue that prevents the clinic from performing the procedure, we are not responsible for any travel or accommodation costs you incur.

9. Price Match Policy

9.1 If you find a cheaper price for the same treatment from one of our partner Clinics within 48 hours of receiving a quote, we will match the price if:

You requested the original quote through us.

You provide verifiable proof of the lower price.

9.2 The matched price must include all applicable taxes and charges. Price match does not apply to typographical errors or promotional vouchers.

10. Intellectual Property and External Links

10.1 All intellectual property on our platform is owned by us or our licensors. You do not acquire any ownership rights by using our services.

10.2 Our platform may contain links to third-party websites. We are not responsible for the content or availability of these external sites and do not endorse them.

11. Data Protection

We take your privacy seriously. Please refer to our Privacy Policy for details on how we collect, process, and protect your personal information.

12. Governing Law and Jurisdiction

12.1 Governing Law: These Terms and any disputes arising from or related to the use of our platform are governed by and construed in accordance with Turkish law, without regard to conflict of law principles.

12.2 Jurisdiction for Medical Services: Any dispute, claim, or controversy related to medical treatments provided by Clinics in Turkey shall be subject to the exclusive jurisdiction of Turkish courts. By using our platform, you acknowledge and agree that any legal action regarding medical services must be brought in Turkey.

12.3 Jurisdiction for Platform and Payment Disputes: For disputes related to our facilitation services, including the Appointment Deposit, booking process, or use of the platform, you may bring a claim either:

In the Turkish courts, or

In the courts of your country of residence, if required by mandatory consumer protection laws.

12.4 Facilitator Disclaimer: We act solely as an intermediary connecting you with Clinics in Turkey. We are not responsible for medical services, outcomes, or any disputes arising from treatments. Any legal claims regarding medical services must be pursued directly against the Clinic under Turkish jurisdiction.

13. Dispute Resolution and Mediation

13.1 Informal Resolution: If a dispute arises, you agree to first engage in good faith discussions with us through mediation before starting any arbitration or legal action. We aim to resolve any disputes quickly and efficiently. If you have concerns, please contact us at contact@viranoma.com before taking legal action.

13.2 Alternative Dispute Resolution (ADR): If we cannot resolve the dispute informally, you may access alternative dispute resolution (ADR) services through an independent third party. We are not obligated to participate in ADR but may agree to it at our discretion.

13.3 EU Online Dispute Resolution (ODR) Platform:

13.4 Jurisdictional Scope: This clause does not affect your legal rights under Section 12 (Governing Law and Jurisdiction).

14. Final Provisions

14.1 We may modify these Terms at any time. Changes take effect immediately upon publication on our website.

14.2 If any provision of these Terms is found to be invalid, the remaining provisions remain enforceable.
